Terms and Conditions

1.1. In these general terms and conditions, the following is understood:

• Moving company: the company that performs the move.
• Customer: the natural person or legal entity that enters into an agreement with the moving company.
• Agreement: the agreement between the moving company and the customer regarding the performance of moves.

2.1. These general terms and conditions apply to all offers, quotes and agreements between the moving company and the customer, unless otherwise agreed in writing.

2.2. Deviations from these general terms and conditions are only valid if they have been explicitly agreed in writing.

3.1. If the customer cancels the move within two weeks before the agreed moving date, the customer is obliged to pay the full costs of the move.

3.2. If canceled within one month before the moving date, the customer must pay 50% of the total costs.

3.3. If canceled more than one month before the moving date, the cancellation is free of charge.

4.1. All quotes are non-binding and valid for 30 days, unless otherwise stated.

4.2. Prices in quotes are exclusive of VAT, unless otherwise indicated.

4.3. The moving company reserves the right to change prices in case of changes in material costs, labor costs or other circumstances.

5.1. Payment must be made within one day after invoice date, unless otherwise agreed in writing.

5.2. In case of late payment, the customer is automatically in default and owes interest of 1% per month, unless the legal interest is higher, in which case the legal interest applies.

5.3. All reasonable judicial and extrajudicial (collection) costs that the moving company incurs as a result of the customer's failure to fulfill their payment obligations are at the expense of the customer.

6.1. The moving company will perform the move to the best of its ability and as a careful professional.

6.2. The customer is obliged to provide all data and instructions necessary for the execution of the move to the moving company in a timely and complete manner.

6.3. The moving company is entitled to have the move performed by third parties.

7.1. The moving company is only liable for direct damage that is the result of intent or gross negligence of the moving company.

7.2. The moving company is never liable for indirect damage, including but not limited to consequential damage, lost profit, missed savings and damage due to business stagnation.

7.3. If the moving company should be liable for any damage, the liability of the moving company is limited to the amount paid out by the moving company's insurance in the relevant case.

8.1. In case of force majeure, the moving company is entitled to suspend or dissolve the agreement at its choice, without the customer being entitled to compensation.

8.2. Force majeure is understood to mean any circumstance independent of the will of the moving company that permanently or temporarily prevents the fulfillment of the agreement.

9.1. Dutch law exclusively applies to all legal relationships in which the moving company is a party.

9.2. Disputes arising from or related to the agreement will be submitted to the competent court in the district where the moving company is established.

10.1. If one or more provisions in these general terms and conditions are at any time wholly or partially null and void or should be annulled, the remainder of these general terms and conditions remains fully applicable. The moving company and the customer will then consult to agree on new provisions to replace the null and void or annulled provisions, taking into account as much as possible the purpose and intent of the original provisions.

10.2. These general terms and conditions are drawn up in the Dutch language. In case of interpretation differences between a translation and the Dutch text, the Dutch text prevails.
